These Terms of Service (“Terms”) govern your use of the Duskwing website and any purchase you make from us. By using our site or placing an order, you agree to these Terms. You also agree to our Refund Policy, Shipping Policy, Privacy Policy, and Limited Warranty, which are part of these Terms by reference.

1. Eligibility. You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Products. We try to describe and display our products as accurately as possible. LED colors and brightness may appear differently on screens than in person, and results depend on your wall surface, lighting, and weather. Sizes, specifications, and battery life are approximate.

3. Pricing and errors. All prices are in U.S. dollars and may change without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel orders placed at that price, even after confirmation. If you’ve been charged, you’ll receive a full refund.

4. Orders. Placing an order is an offer to purchase; we accept it when we ship it. We may refuse or cancel any order, including suspected fraudulent orders, orders placed for resale, or orders exceeding reasonable quantity limits. If we cancel an order after payment, we’ll refund you in full.

5. Payment. You agree to provide accurate payment information. You authorize us and our payment processors to charge the total shown at checkout, including applicable taxes and shipping.

6. Shipping and risk of loss. Shipping is governed by our Shipping Policy. Risk of loss passes to you when your order is delivered to the shipping address you provided.

7. Returns and warranty. Returns are governed by our Refund Policy. Product defects are covered by our 1-year Limited Warranty.

8. Safe use. Our products are decorations, not toys. Keep products and batteries away from young children and pets, and follow all included instructions. Don’t submerge products or use them near open flames, and remove batteries before long-term storage. Before full installation, test the adhesive on a small, hidden area, because adhesives can react differently with different paints, finishes, and surfaces. Except as required by law, we’re not responsible for surface damage caused by mounting or removing products.

9. Reviews and submissions. If you submit a review, photo, or other content, you confirm it’s yours, truthful, and based on your genuine experience. You grant us a non-exclusive, royalty-free, perpetual license to display it in connection with our store and marketing. We may remove content that is unlawful, offensive, or unrelated to our products. We won’t remove reviews solely because they’re negative.

10. Intellectual property. All content on this website, including text, images, logos, and the Duskwing name, belongs to us or our licensors. It may not be copied or used commercially without our written permission.

11. Prohibited use. You may not use our site for any unlawful purpose. You may not interfere with its security or operation, scrape it with automated tools, or use another person’s payment information.

12. Disclaimer. Except as stated in our Limited Warranty, our website and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied. Implied warranties that can’t be disclaimed are limited as described in our Limited Warranty.

13. Limitation of liability. To the fullest extent permitted by law, we’re not liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim won’t exceed the amount you paid for the product involved. Some states don’t allow these limitations, so they may not apply to you.

14. Indemnification. You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or your misuse of our products.

15. Governing law and disputes. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, except that either party may bring an individual claim in small claims court where eligible. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

16. Changes. We may update these Terms at any time. The version in effect when you place an order applies to that order.

17. Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
